The Senators don't owe any deference to Obama's pick for the supreme Court. Their job is to grill, uncover and get on the record, the social and political views of Sotomayer and to challenge her record where appropriate. This was done by the Democrat Senators to Alito and Roberts. In the end, there is no doubt that Sotomayer will be confirmed: first, because the Democrats control both the Committees and the overall Senate and second, as a matter of practical politics, because the Republicans cannot afford to reject a Latino and a woman. In the twisted politics of this country, the Democrats have optimized playing to special interest groups and so only the Democrats get a pass on challenging and even viciously attacking minority (Alberto Gonzales, Attorney General appointed by Bush) and female candidates (Sarah Palin) for .
In a nonpartisan hearing, Sotomayor would get FAILING GRADES for:
1. her comment made to at least six audiences over a number of years and published once, about a "wise Latino woman" making better decisions than a "White male who hasn't had that experience",
2. her decisions on the Appellate Court being reversed 5 out of 7 cases by the U.S. Supreme Court, where her positions were in the direction of making social policy and not following the Constitution,
3. her position on the Second Amendment which relies on an antiquated 19th century ruling to say that the right to bear arms does not extend to the states and thus to individual citizens; this will reach the Supreme Court when she is a member.
